We understand it takes different types of bookings to keep the business thriving. A varied commission structure was created to make it more beneficial for You to make more product options available on BookBarbados.com.
General commission is 20% on all car rental rates and VAT EXCEPT:All rates must be loaded in USD as we transact business internationally in USD as the base currency. We reserve the right to convert into localized currencies across source markets.
TAXES & FEES:Processing credit card payments can get really expensive, especially when you add it to all the other costs of running your business.
BookBarbados.com will collect 100% of all payments from the customer in advance. Refunds for cancellations will be issued based on Your car rental’s individual cancellation policies and penalties.
For each booking You will receive an amount equal to the car rental selling price less the commission. The commission amounts deducted will be in accordance with the type of booking - General, Staycation, Islandcation or Extra Services/Add-ons.
For each booking You will also receive the full amount of service charges, levies and any fees laid out in Your pricing schedule, except under those circumstances where BookBarbados.com is required to pay any tax or levy directly to the Barbados Revenue Authority.
Payments due to You will be processed by local bank transfer no more than 72 business hours after the car rental has been rendered.
General Terms
Car Availability – You agree that the product availability provided to BookBarbados.com will be at least as favorable as the product availability offered through Your own direct channel and any other third-party channel for the same experience.
Price – You agree that the rates and rate plans provided to BookBarbados.com will be at least as favorable as the rates offered through Your own direct channel and any other third-party channel for the same room experience (i.e. price integrity).
Policies – You agree that all rules, restrictions, fees and booking policies – including cancellation/no show terms and penalties – will be no more restrictive than those applied on Your own direct channel and any other third-party channel for the same room type.
Guest Cancellations - You agree that You will not cancel or encourage guests to cancel bookings. Guests should cancel bookings directly through BookBarbados.com. If the guest requires cancellation assistance, You agree to contact the BookBarbados.com customer service team for guest follow up. You agree to load and update all seasonal cancellation policies in the extranet to avoid any default policy being applied.
Supplier Cancellations/Changes to Product – You agree that if You are reasonably unable to honor a previously confirmed booking that You will first immediately inform BookBarbados.com. You agree that it is Your responsibility to then find comparable experience and engage with the guest to ascertain acceptance of the alternative within 72 business hours. You agree that payment arrangements for the new experience will be settled directly between the two suppliers with no requirement from BookBarbados.com.
Chargebacks – You agree that You are responsible for providing any supplemental documentation required by the financial institution to counter the chargeback claim within the stipulated time period. In the event that the guest chargeback is successful, and the financial institution refunds the guest, BookBarbados.com will invoice You for the full chargeback amount as well as any associated fees. Payment will be due within 14 days of the invoice date. Failure to make the payment within the window will result in the product being dimmed from the site. Reactivation will occur upon settling of the outstanding amount. Should payment not be received within 30 days, BookBarbados.com will deduct the outstanding amount owed from our next payment to You. Failure to pay within 90 days, will result in the commencement of debt recovery proceedings against You.
Car Information – You agree to load and update all product information and details in the BookBarbados.com extranet such that all public information displayed on the portal is current and accurate. You acknowledge that You are solely responsible for accuracy of the product content.
Guest Experience – You agree that any guest booking through BookBarbados.com will be treated in the same manner as if they booked directly through Your own channel or any other third-party channel. You agree that any guest complaints relating to Your product will be handled with urgency and in a fair and reasonable manner. If a guest cancels all or part of a booking due to dissatisfaction with Your experience, once the refund amount is agreed between You and BookBarbados.com, BookBarbados.com will invoice You. Payment will be due within 14 days of the invoice date. Failure to make the payment within the window will result in the product being dimmed from the site. Reactivation will occur upon settling of the outstanding amount. Should payment not be received within 30 days, BookBarbados.com will deduct the outstanding amount owed from our next payment to You. Failure to pay within 90 days, will result in the commencement of debt recovery proceedings against You.
Intellectual Property – You supply and warrant that You have all the necessary rights, licenses, consents and authorizations required to provide Content related to Your Experience, including but not limited to photographs, images, designs, text, audio, video, descriptions and facilities to ensure optimum distribution of the product. You agree that the reproduction, display, or distribution of such content does not and will not violate the rights of any third party. Upon prior notice, You also agree to grant BookBarbados.com reasonable access to the Experience to obtain images for the purposes of identifying, promoting, merchandising and/or obtaining Bookings for the Experience.
Booking Process – BookBarbados.com will remit a notice of each Booking processed through the portal. You agree to honor every Booking for which You receive a Booking notification.
Display and Marketing - Car Rentals displayed on BookBarbados.com will appear in an order determined by BookBarbados.com in its sole discretion. You agree that BookBarbados.com may also on occasion offer discount pricing for Your product solely upon receipt of Your confirmation of Your participation in these promotions or campaigns.
This Agreement is effective from the date of signing and is valid for a period of one year. This Agreement will auto renew until either party chooses to terminate.
Either party may terminate this Agreement for any reason by giving at least thirty (30) days' prior written notice to the other party. At the termination of this Agreement both parties agree to:
Confidentiality - Confidential Information means any trade secrets and/or other proprietary, non-public information not generally known relating to a Party's business, product plans, designs, costs, prices, finances, technologies, marketing and targeting plans, methods of source of business, business opportunities, customers, suppliers, vendors subscribers, employees, research development, security codes, access codes, rates and the terms of this Agreement. Each Party agrees to refrain from disclosing the Confidential Information after disclosure and will use it only in pursuance of the receiving Party's business relationship with the disclosing Party. Each Party may release Confidential Information to their legal and financial advisors under the same duty of confidentiality outlined.
Data Protection – Each Party agrees that it has in place and will maintain, or establish and maintain, adequate security procedures and controls to prevent the unintended disclosure of, and the unauthorized access to or misappropriation of, any personal data or information of any guest. Each Party agrees that it will process, store, transmit and access any guest information in compliance with applicable law and, for guest information that includes payment information (including, without limitation, credit card, debit card or financial account information), will do so in compliance with the current with the current Payment Card Information Data Security Standard. Unless You receive consent directly from the guest, You and Your affiliates will not directly or indirectly engage in any solicited or unsolicited marketing, promotional, or similar communications with any guest that has booked a room through the BookBarbados.com portal.
Public Announcement or Communications – You agree to consult with BookBarbados.com with respect to the contents of any communication or marketing material it proposes to have with the media on any external party related to BookBarbados.com or its relationship with them, and any announcement or statement it intends to release to the press by providing BookBarbados.com with a draft thereof. You agree that You will not release any communication, marketing material or press release unless and until it first obtains BookBarbados.com' written consent.
Anti-Fraud Cooperation – You acknowledge that You are solely responsible for ensuring that the identification presented by any guest is valid and matches the Booking information provided to You by BookBarbados.com. If a Party believes a Booking may be or is fraudulent, or certain data provided by a guest cannot be verified, then the Parties will work in good faith to address such fraudulent or potentially fraudulent Bookings. In the event of a fraudulent or potentially fraudulent Booking, BookBarbados.com may cancel such Booking at any time.
Health and Safety – At BookBarbados.com' request, You agree to promptly provide BookBarbados.com a copy of Your annual operating license and/or similar certificate, if any, indicating Your compliance with the health and safety obligations required for You to operate legally under local Barbados law. You also agree to ensure that any such operating license(s) and/or certificate(s) remains valid for the duration of this agreement and that any costs associated with the issuance and/or renewal of such operating license(s) and/or certificate(s) shall be solely Your responsibility.
Taxes and Levies – You acknowledge that You are solely responsible for the accuracy of the Tax and Levy information entered into the BookBarbados.com extranet. You are responsible for accounting to the Barbados Revenue Authority for any applicable Tax or Levy amounts received by You for any Bookings except if the Barbados Revenue Authority requires that BookBarbados.com pay any tax or levy directly to them.
Insurance – You represent and warrant that at all times You have liability insurance coverage in an amount that is consistent with the best industry practice and agree to provide proof of such insurance upon request by BookBarbados.com
Legislation and Courts of Jurisdiction – The application and interpretation of this Agreement will be governed by the laws of Barbados.
Representations and Warranties – In addition to any other representations and warranties made by You in this Agreement, You hereby represent and warrant that You have authorized the individual entering into this Agreement on Your behalf to take such action Your behalf; this Agreement constitutes a valid and binding obligation enforceable against You in accordance with its terms; the performance of Your obligations under this Agreement will not violate any agreement or obligation between You and any third party; Your performance under this Agreement with comply with the terms of this Agreement; and You hold all licenses, permits and authorizations required to make Your rooms available for booking through the BookBarbados.com portal and to otherwise comply with Your obligations under this Agreement.
Dispute Settlement Clause – If any dispute arises in connection with this Agreement, the parties agree to enter into mediation in good faith to settle such a dispute. No party may commence any court proceedings in relation to any dispute arising out of this Agreement until it has attempted to settle the dispute by mediation and either the mediation has terminated, or the other party has failed to participate in the mediation, provided that the right to issue proceedings is not prejudiced by the delay.
Indemnification - Both parties hereby agree to defend, indemnify and hold harmless the other party, its directors, officers, employees, agents, stockholders and affiliates harmless from and against all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs and expenses (including but not limited to reasonable attorney's fees and costs) whether or not involving a third party claim, which arise out of or relate to any act or omission of the indemnifying Party or any of its representatives' acts, omissions, negligence or breach of any terms of this Agreement.
